ADVERTISING TERMS AND CONDITIONS

  1. Agreement to Terms

1.1 By submitting an advertisement for publication in the Tyne Valley Express, the advertiser agrees to the following terms and conditions.

  1. Advertisement Submission and Acceptance

2.1 All advertisements are subject to acceptance by the Tyne Valley Express. The Tyne Valley Express reserves the right to refuse any advertisement at its sole discretion.
2.2 Advertisements must be submitted by the deadline specified by the Tyne Valley Express. Late submissions may result in non-publication.

  1. Advertiser’s Warranties and Representations

3.1 The advertiser warrants that the advertisement is legal, decent, honest, and truthful, and complies with all relevant laws and regulations.
3.2 The advertiser warrants that they have the right to use any content, including images and text, included in the advertisement.
3.3 The advertiser indemnifies Tyne Valley Express against any claims, costs, damages, or losses arising from the publication of the advertisement.

  1. Content and Format of Advertisements

4.1 Tyne Valley Express reserves the right to alter the size, shape, or format of an advertisement to meet the magazine’s layout requirements.
4.2 Tyne Valley Express will make reasonable efforts to ensure the advertisement is published as submitted, but minor modifications may be necessary.

  1. Liability

5.1 Tyne Valley Express will not be liable for any loss or damage caused by errors or omissions in the publication of advertisements.
5.2 Tyne Valley Express’s liability for any breach of this agreement shall be limited to the amount paid by the advertiser for the advertisement.

  1. Cancellation and Amendments

6.1 Cancellations must be made in writing and received at least 7 days prior to the advertised deadline date for each magazine.
6.2 Amendments to the advertisement must be submitted in writing and are subject to acceptance by Tyne Valley Express. Cancellations of premium placement advertisements require at least one full issue’s notice (2 months) prior to the deadline date.

  1. Payment Terms

7.1 Payment for advertisements must be made in full by the date specified on the invoice.
7.2 Failure to make timely payment may result in the removal of the advertisement and refusal of future advertising requests.
7.3 All fees are non-refundable once the advertisement has been published.
7.4 Advertisers who commit to a block booking of 3 issues will be entitled to a 10% discount on the total advertising fees for those issues, while those who commit to a block booking of 6 issues will receive a 20% discount on the total advertising fees for those issues. These discounted rates are contingent upon the advertiser fulfilling the full commitment for the specified number of issues.
7.5 In the event that the advertiser terminates the agreement prior to the completion of the agreed-upon term (either 3 or 6 issues), the advertiser will be required to reimburse Tyne Valley Express for the discounted fees that were applied, based on the number of issues taken. Additionally, a £30 administration fee will apply to cover the costs associated with the early termination of the agreement. This fee will be invoiced along with the reimbursement of the missing fees.

  1. Publication Schedule

8.1 Tyne Valley Express does not guarantee the publication of any advertisement on a specific date or in a specific issue.
8.2 Tyne Valley Express reserves the right to reschedule the publication date of any advertisement.

  1. Distribution

9.1 The Company reserves the right to change, alter, or amend the distribution areas at its sole discretion. This may include, but is not limited to, the addition, removal, or modification of geographical regions or delivery zones within the Tyne Valley or surrounding areas, as the Company deems necessary. Such changes may be made without prior notice to the customer, and the Company will not be liable for any loss or inconvenience caused by these changes.
9.2 Any reduction in distribution will not entitle advertisers to a refund or a reduction in advertising fees.
9.3 If revenue levels fall below acceptable thresholds, the Company may reduce the delivery of its magazines by no more than 15% of the advertised distribution areas. This is a strategic decision aimed at preserving financial health, focusing on the most impactful areas, and ensuring the sustainability of the publication. This approach allows the Company to continue delivering value to advertisers while effectively managing costs.

  1. Advertisement Success and Refund Policy

10.1 Tyne Valley Express makes no guarantees regarding the success or response to any advertisement. The cost of the advertisement covers the expenses associated with printing and distribution.
10.2 No refunds will be offered if the advertiser receives no response from the advertisement.

  1. Confidentiality

11.1 Tyne Valley Express will treat all advertiser information as confidential and will not disclose it to third parties except as required by law or with the advertiser’s consent.

  1. Governing Law and Jurisdiction

12.1 These terms and conditions are governed by the laws of England and Wales.
12.2 Any disputes arising from or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Miscellaneous

13.1 If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
13.2 These terms and conditions constitute the entire agreement between Tyne Valley Express and the advertiser and supersede all prior agreements and understandings.

  1. Data Protection

14.1 When you submit information to Tyne Valley Express, a record is kept of your contact details and booking information. This helps the Publisher to administer your current and any future advertisements. By submitting information, you consent to these records being kept in compliance with the General Data Protection Regulations (GDPR).
14.2 We may share your contact details with selected partners and affiliates for relevant business purposes, such as promotional offers, advertising opportunities, or related services. Any such sharing will be conducted in compliance with GDPR, ensuring that your data is handled securely and responsibly.
